Compensation and reimbursement models are another method of controlling access, cost, and quality in a managed care environment. An MCO doesn’t have direct control over physicians or hospitals but through contractual agreements that set incentives for meeting agreed-upon standards, it can exert influence.

This week, you are required to write an essay on the following topics:

    Jim and Laura Buyer visit the local car dealership because they are interested in buying a new car. The car they currently have is aging and is starting to have mechanical problems. Jim and Laura would share the new car, and use it to go back and forth to work and school. Before going to the dealership, Jim and Laura decide that they can only afford $400.00 a month in car payments.

    Once at the car dealership, Jim and Laura meet Stan Salesman. Stan shows them several vehicles and Jim and Laura test-drive several of the cars. Jim and Laura particularly like the blue 4-door sedan.  Therefore, they agree to give Stan Salesman a $100.00 deposit to hold the car for a day. Stan Salesman does not give them the receipt but guarantees that the $100.00 is refundable. No documents were signed.

    The next day, Stan Salesman calls Jim and Laura to ask them when they would like to take delivery of the car. Jim and Laura, on the way home from the dealership, decided that they were not going to buy the car because they did not want to spend that money each month. Therefore, Jim and Laura tell Stan salesman that they have decided not to buy the car and request their $100.00 deposit back.

    Stan insists that the $100.00 was a deposit on the car and was meant to be part of the contract to buy the car. Stan is very persistent and insistent that Jim and Laura have contracted to buy the car; therefore, the $100.00 will be applied to the purchase price of the car. Jim and Laura are shocked and angry as not only do they not want to spend the money, but now feel as though they are being duped by Stan Salesman.

    Jim and Laura have an appointment to see a lawyer in a few days, but know you are a student taking a business law class and come to you for advice. They are very frazzled, and understandably upset that they may have just purchased a car. Since you have been taking business law, you have read and understand the elements of a contract and the defenses to a contract. Therefore, although you are not a lawyer, you provide some basic advice from what you’ve learned in your business law class.

    In three to five (3-5) pages, advise Jim and Laura based on the above facts as presented, the material provided in the text, and material covered in the lecture. In your paper, be sure to address the following:

    1. Define the elements of a legal contract using examples from the scenario where applicable.

here is one of my previous essays i wrote.

Music is always around my world. Music is the most important thing for me.I was born into  a musical family. My father is a music teacher in the Music Middle School Affiliated to the Shanghai Conservatory of Music. He is the director of Brass and Woodwinds. He teaches Trombones and Tubas.

My family lived on campus since my mother became pregnant. My father’s colleagues always said I am growing with music. When I was three years old, I learned violin with my neighbor who taught violin in The Shanghai Conservatory of music. Since I was going  to school, I did not have time for practice, but I still watched the musical and opera on the way to school in my father’s car. Fantasia is still my favourite musical. There is one piece that influenced me a lot — “Rhapsody in Blue” by George Gershwin. This piece had an amazing piano part. I heard a lot of piano music before, but that one made me interested in piano. When I was six years old, my first instrument moved to my room: a piano. At the beginning, It was not very good start. I did not know how to read the music until I had lessons with my piano teacher for about three months. My dad was really mad about this, or he can not believe it. I could play a sonata, but I could not read music. I watched my teacher’s hand moving carefully and listened to the music around and around. The I could play it and without sheet music.

When I was 3rd grade, my school work was getting harder. That reduced my happiness.I did not have enough time for practice,but I still kept practicing everyday. On my eighth birthday party, my father’s friend who was my first harp teacher gave me the best gift a little harp. I always said the harp was my favourite ‘toy’.

A lot of people asked me, ‘your father is a trombone teacher, why didn’t you choose trombone?’ Although I did not learn trombone with my father, I learned a lot of things from him. He always gave some suggestions for practice and choosing music. I went to my father’s school since I was in the 4th grade. Then everything changed, I became more confident and more outbound. I went abroad for exchange programs many times. I went to different countries. I learned different cultures and the different ways of study. I want to Europe every summer for summer camp. Since I went to Europe, I knew how the composers were thinking and feeling because classical music is not from my country. I wanted know more about the real classical music. Music changed my life and made me better.
