Question 5 Why is there no 5th Amendment protection concerning written word of incriminatory documents written by a target/ suspect/ defendant (generally speaking) when such protection would exist regarding the spoken word …the right to remain silent etc… Question 6 Chapters 5 and 6 of the Bailout detail Barofsky’s frustration in attempting to get a prosecutorial agency to actually prosecute the parties whose criminal activity the office of the IG has uncovered. What is your opinion of this limitation on the IG’s office to act as an investigator and recommender of action rather than being the actual enforcer? Can you see any advantage for IG’s in playing this more limited role?
