DISCUSSION: What are the main purposes of Competition Law overall, Competition Law is governed by national states or unions such as the EU and is hence an instrument of economic policy – the purpose of competition law is the protection of the consumer and to a certain extent protection of competitors. A definition is provided by Whish: to protect the process of competition in order to maximize consumer welfare [[1]]. What makes competition law complex is that it does not deal with finite legal matters, but has a considerable influence by the economy and economists in essence the economical analysis of markets within a legal process [[2]]. The reach of competition law encompasses areas of anti-competitive agreements, abusive behaviour, mergers and public restrictions of competition. It is debated whether the other mentioned purpose, protection of the competitor is to be equal to our subject to the protection of the consumer. In the US in the 60ies there was political support for SMEs to have a fair chance in the market. This approach is also supported in modern day EU, where article 102 of the TFEU has been applied in cases to support competitors [[3]]. The inherent problem with trying to support both the consumer and competitors at the same time is that protection of the competitor might not be to the advantage of the consumer. In the EU context it is discussed that the TFEU articles 101(1) are to a certain extent linked to article 34 which relates to the free movement of goods and thereby the EU agenda behind the application of Competition Law is indeed to protect to furtherance of the internal market. This is evidenced in GlaxoSmithKline v Commission of the EU. Odudu asks whether to what extent competition law can be used to achieve market integration objectives [[4]]. The question derives from the mentioned court case since GlaxoSmithKline argued well that the involved pricing system did indeed not impede on consumer welfare. The ruling of the Commission though was that the agreement impeded market integration and was consequently prohibited through article 101 of the TFEU [[5]] Why is the definition of Relevant Market important in Competition Law? In short, the definition of relevant market is crucial in order for the courts to make sounds decisions when it comes to potential infringements of competitive law. This point is made in the EU Commission Notice article 4. [[6]]. If abuse by a competitor in a market is to be determined it is obviously fundamental that the relevant market is defined. In Continental Can Co Inc, the Court of Justice reversed the Commissions ruling since it failed to define the correct product market [[7]]. In the case itself this crucial point if further hammered out [[8]] Elements of competition policy when assessing Market Power Relevant Market and Market Shares cannot in their own right determine to what extent a specific player in the market can influence the market. Measures of power needs to be defined as well. By power, it is normally understood that this relates to price control, output control or similar ways of manipulating consumer choice [[9]]. Further elements that influence Market Power is demand substitutability, supply substitutability and potential competition [[10]]. Market share and market power are interlinked and as a fundamental conflict it is often seen in court cases that firms tend to attempt to define markets quite wide in order to diminish the perceived level of power [[11]] Demerits of Competition Law/Policy As mentioned in the beginning of this DQ the driver behind competition law is politically enshrined which raises the question who controls the controller. It is established that competition law and the related governance is complex so which entity should be charged with determining what is acceptable in the world of business this in turn points back to the quote from the AT&T era.
