Week 3: Analyzing Social Problems and Social Policy The skills you implement in order to address a social problem might seem obvious when you are working on a problem one client is facing. How do you transfer those skills to address a problem that faces an entire population? In your analysis of the problem and of potential policy solutions, how do you account for the variety of ways in which this problem might be affecting families, groups, and communities within that population? You must have an in-depth understanding of the social problem. Then, as a social worker, you must ask: Which individuals will the policy help? How much will it help them? Whom might the policy harm, and how much will it harm them? Asking these questions when analyzing social policy can help to ensure that the policies you inform do not add to the existing social problems. This week, you analyze social problems presented in the social work case studies in order to develop approaches to addressing these social problems. You also examine the prevalence of a social problem that interests you. Learning Objectives Students will: Analyze the impact of social policies on social agencies and social work practice with clients Apply approaches to address social problems through social policy in social work case studies Analyze steps to ensure that the social work profession defines problems that represent oppressed and marginalized groups Analyze a social problem Analyze theories that support a social problem Analyze approaches scholars and policy analysts use to address a social problem Learning Resources Required Readings Plummer, S.-B., Makris, S., & Brocksen, S. In his book Natural Law, the noted European legal philosopher A.P. dEntreves asserted the following concerning the Nuremberg trial of Nazi leaders after World War II: “No doubt the provisions for the Nuremberg Tribunal were based, or purported to be based, on existing or positive international law. “But I strongly suspect that the boundaries of legal positivism were overstepped, and had to be overstepped, the moment it was stated that the trials were a ‘question of justice.’ The principle nullum crimen sine poena (no crime without punishment), on which the sentences were grounded, was a flat contradiction of one of the most generally accepted principles of positive jurisprudence, the principle of nulla poena sine lege (no punishment without law). “Thus, after a century of effort to eliminate the dualism between what is and what ought to be from the field of legal and political experience, natural law seems to have taken its revenge upon the very champions of the pernicious doctrine that there is no law but positive law, or that might equals right, since for all practical purposes the two propositions are perfectly equivalent.” (pp. 106-107) Directions for assignment: Write an essay of 1,250 -1,500 words in which you answer the following questions: 2.How, according to dEntreves, did that trial do so? 3.Who might be the “very champions” of positive law that dEntreves is addressing here? 4.Is dEntreves defending or attacking the tradition of natural law? What doeshe imply about law and society, natural versus positive law, if he is defending the principle nullum crimen sine poena (no crime without punishment)? Locate three to four credible sources in support of your content. Prepare this assignment according to the guidelines found in the APA Style Guide, an abstract is not required.
