Literature Searches An important step in the EBP process is reviewing the current body of literature to better understand the subject or topic in which you are interested. If the undertaking is categorised as being in a dominant position, article 102 TFEU is applicable. Dominance position, and abuse of the dominance A dominant position has been tested in United Brands v Commission[1] to a position of economic strength used by the undertaking to impede competition. Article 101(2) make void any agreements or decisions prohibited that is prohibited by article 101(1)[2] TFEU, subject to exceptions by article 101(3). It appears that the dominant position per se is not prohibited, but the abuse thereof. Dominance refers to a position of substantial power for an undertaking over a specific product market in a particular geographical market, and if dominance is not proven there can be no abuse.[3] This is a very significance averment in the determination of abuse of dominant position, to make it clear that being a big, dominant undertaking is not necessarily against competition laws.
