DISCUSSION. The courts have often stated that one of the most basic duties of a bank is to pay cheques drawn by customers on their accounts at the bank.[1] This duty is owed to the customer, not to the payee.[2] The common law definition of banking has always evolved and when it comes to effective instructions of a customer to a bank such as payments, these rules are generally subject to the terms of the contract between the bank and the customer.[3] Evolving banking practice especially as regards automation of cheque clearing and electronic processing of banking data has led to banks giving specific.[4] Where these instructions or restrictions form part of the bankercustomer contract, they will affect the duty of the bank to pay the cheques for that customer. However, such limitations cannot be imposed unilaterally on a customer after the contract has been made. Although this may be the rule, computerised bank records and modern technology for verifying cheque signatures have meant that most banks are more flexible about cashing cheques outside the customers own branch. The banks duty to pay in relation to any particular cheque ends when the customer countermands payment. The collection of cheques can be risky especially when the person who delivers the cheque has no title, or a defective title to the instrument. Facing a liability at common law, the collection bank invariably turns to section 4 of the Cheques Act 1957[5]. Lord Denning MR made an observation in the Kirkwood case when he said there are two. characteristics usually found in bankers today and that is they accept money from, and collect cheques for their customers and credit them, honour cheques or orders drawn on them by their customers when presented for payment and debit customers accordingly.[6] Burnett v. Westminster Bank case raised the interesting and fundamental question of what is necessary to alter the basic banker- customer contract.[7] There are two other types of circumstance in which the banks duty to pay is altered. That is where the cheque appears to have been altered or is otherwise irregularin dishonouring such a cheque, the bank is acting to protect the interests of the customer and also where the law requires it.[8] Banking services have always evolve and now that we have services such as the introduction of Electronic Funds Transfer at Point of Sale, Faster Payments, Direct Debits and Telegraphic Transfers and so on in this era of globalization.
