In this essay, you will examine resorts from two perspectives: the guest and the operator.

In this essay, you will examine resorts from two perspectives: the guest and the operator.

Part 1: A resort vacation stay can be considered an unnecessary expense for some; however, others consider it a necessary evil. Choose a resort in the United States that you would consider visiting and address the following:

· Describe your resort, and plan your stay to be at least five days to a week. What made you choose this resort? Does your chosen resort capitalize on new market trends? How so, or why not?

· Prepare a food expense report for your stay. Include all foods consumed and their costs, from breakfast, lunch, dinner, snacks, room service, and convenience items, such as sodas and alcohol.

· Write an expense report (organized by day) with the total spent. Include travel, lodging, daily food totals, entertainment, and recreation. Is this vacation something you would take advantage of if you had the financial capability? Why, or why not?

· Why did you pick this type of resort over others? Compare and contrast your choice to either a timeshare, cruise ship, specialty resort, casino, or other.

Part 2: The operations of a resort property are financially complex. Imagine you are the resort owner and operator for the resort you choose in Part 1 and address the following:

· Identify some sustainable programs or efforts that could make this a less-complex function. In other words, how can resort management be rewarded financially for implementing “green” or sustainable programs?

· What are the management differences between a resort property and a hotel?

· What are the financial challenges? Include a discussion on seasonality and competition.

Your APA formatted paper should be at least three pages in length (not including the title and references pages). In addition to your textbook, you are required to use at least one article from an Online Library to support your paper.

Describe three (3) alternatives to incarceration that juvenile courts currently use. Provide examples of such alternatives in practice to support the response.

Assignment 2: Alternatives to Incarceration

Due Week 10 and worth 120 points

Recent study illustrates that nearly two (2) million juveniles are processed through juvenile courts across the United States each year. Depending on the nature of the crime, juveniles may face detention or incarceration if they are convicted. Given the fact that many courts are reluctant to incarcerate criminal offenders, judges often consider alternatives to incarceration. The driving force behind these alternatives is to save taxpayer money yet still demand offender accountability and impose sanctions for criminal behavior.

Use the Internet or Strayer databases to research the use of sanctions other than incarceration or detention for juvenile offenders.

Write a two to three (2-3) page paper in which you:

Examine the underlying historical and economic reasons behind the quest for alternatives to incarcerating offenders in jails and prisons.
Describe three (3) alternatives to incarceration that juvenile courts currently use. Provide examples of such alternatives in practice to support the response.
Discuss the significant societal and individual benefits of imposing sanctions or punishments that do not involve removing an offender from his / her family or community.
Use at least three (3) quality references. Note: Wikipedia and other Websites do not qualify as academic resources.

Your assignment must follow these formatting requirements:

Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA or school-specific format. Check with your professor for any additional instructions.
Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required assignment page length.

Write a memo on business dispute, such as a contract dispute, a warranty claim, or a claim by a customer that they were injured by one of your employees or products (commonly referred to as a “tort” case — which we’ll talk about in this course).

Describe it as if you were writing for your boss who wants to know how a case like the one you have chosen would be processed throughout the various legal phases in a state court system. The important thing to focus on here is this is STATE court — that means it is the courts organized by the laws of your individual state, not the federal court system. Each state has its own court system.

Discuss the state court litigation process for a business dispute. For this assignment, assume that the dispute involves a contract dispute, a warranty claim, or a claim by a customer that they were injured by one of your employees or products. Assume also that the amount of money being claimed is fifty thousand dollars ($50,000) and that both parties are from the same state.

Use the link below to find information about the courts in your state. If you are not living in the United States, then pick a state.

What specific court would the case have to be filed in (where does it start)? After a verdict, to which court could a party file an appeal?

http://www.ncsc.org/Information-and-Resources/Browse-by-State.aspx

Be sure to discuss how a lawsuit is commenced, what the steps are before a trial starts, and how far it can be appealed after a verdict. For all state court cases, you can assume that there is no federal court that would or could get involved so do not mention anything about federal courts.

When you discuss ADR, explain the difference between negotiation, mediation, and arbitration. Discuss only those three and discuss all three.

Which of these ADR methods do you think would be the most appropriate? Why?

Required elements:

Discuss the differences in costs and benefits of going through traditional litigation and pursuing ADR in this case (Consider for example, why one of the parties in the case you’re looking at may have preferred keeping the case out of court).
No more than 800 words.
Format is consistent with APA guidelines.
