Option 1: Using a pair of cases that deal with the same social issue from the Supreme Court
of Canada, analyze the social aspects of the two decisions. You must explain why the
decision was arrived at, not necessarily using the rationale provided by the judges, but rather
by providing an understanding of the social forces involved. Ideally you will engage the
concepts learned in the course as part of your explanation. You should account for the
interveners: Why these interveners? What was at stake for them? If a decision was not
unanimous, then what did the judges disagree on? Where there social policy aspects to the
decision that led to the disagreement?
Engage as many of theorists encountered in the course in your
analysis as possible. Refer to at least one relevant Supreme Court of Canada case.Supplemental informations: It should be double spaced, 12 point Times New Roman Font with 1 margins on all sides. You must use legal style citations Argument: This component assesses how well you applied the theory to the case, the
sophistication of the analysis and the appropriateness of the case(s) and theories chosen.
Evidence: The component assesses whether you have provided appropriate evidence for your
assertions. Attention must be paid to the quality and appropriateness of the evidence. You must
use the best available evidence. Quality of evidence is assigned as follows: a) Peer-reviewed
academic journals b) Court cases (the higher the court the better) c) Academic books d)
Government reports e) Non-academic books f) Newspaper reports g) Anything else.
Writing: This component assesses the writing in the paper, including grammar and style.
Citations: This component assesses how well you have used legal citations.
