That report should include these three components: 1. A clear account of the current existing Canadian law concerning hate speech. This will require a review of the relevant statutes themselves in the Criminal Code, i.e. C.C. 319(2) + (3), and R v. Keegstra case (which is its most important Supreme Court precedent), and the relevant sections of the Charter of Rights and Freedoms. 2. Advice to the government on whether or not the law should be changed (and, if so, to specify the changes you propose), or remain as it stands. 3.Whether your recommendations involve changing the existing law or leaving it as it is, you need to defend your position with reasons and clear arguments which would require (1) reviewing the main arguments found in the Keegstra decision (both sides of the debate are included there) and (2) reference to one or more of the thinkers discussed in this course (Mills On Liberty). In sum: Detail what the current status of the law is in Canada, and provide an assessment of that law in light on the relevant views and arguments, drawing on the majority and minority judges from Keegstra, as well as on one or more of the legal theorists we have been working through in this course: Mill, Hart, Fuller, Devlin or Dworkin. (Note: While I believe that our best resource for this discussion is Mills On Liberty, you are of course encouraged to consider other relevant views as well.) In order to make your case, you may also find it useful to consider other legal applications of this law (besides in Keegstra) or to look to comparable laws in other jurisdictions or countries. This is fine, but do not use more sources than you absolutely need in order to articulate and defend your policy proposal. A entirely strong essay could be written without seeking out material outside our assigned readings. Your essay is intended to be argumentative; it is not a research paper.
